Terms and Conditions

By registering for or attending any Driven Young Founders Pass Event (hereinafter referred to as an "Event"), you (hereinafter referred to as "Participant") agree to be bound by these Terms and Conditions. These terms govern your participation in all Driven Young Founders Pass Events, including but not limited to international and domestic escapes, annual summits, and any other qualifying Founders Pass experiences (collectively, "Events"). Driven Young Pty Ltd (hereinafter referred to as the "Company") reserves the right to amend these Terms and Conditions at any time, with reasonable notice provided to Participants.
1. Overview and Eligibility
1.1 Scope of These Terms
These Terms and Conditions apply to all Events organised under the Driven Young Founders Pass membership, including multi-day domestic and international retreats and escapes, annual summits, and any other event type designated as a Founders Pass Event by the Company. These Terms do not apply to Founders Table dinners or other events not expressly designated as Founders Pass Events.
1.2 Eligibility Requirements
To attend any Event, each Participant (including any Plus One, as defined in Section 7) must satisfy all of the following criteria at the time of registration and throughout the Event:
- Be aged 18 years or older;
- Be aged under 40 years at the time of the Event commencement date;
- Hold a valid Founders Pass membership (or be a registered Plus One of a current Founders Pass member); and
- Comply with all applicable laws and the Driven Young Community Code of Conduct.
The Company reserves the right to verify eligibility at any time and to refuse or revoke attendance where eligibility criteria are not met, without refund.
2. Event Details and Changes
2.1 Event Information
Full details for each Event, including dates, location, schedule, accommodation options, inclusions, and pricing, will be provided to eligible Founders Pass members in advance of registration opening. Event details are subject to change and the Company will provide reasonable notice of any material changes.
2.2 Accommodation and Inclusions
Unless otherwise stated in the Event-specific materials, the Company will provide accommodation for the duration of the Event, inclusive of meals and activities outlined in the event program. Any services, activities, or experiences not explicitly included in the event program are the sole financial responsibility of the Participant.
Accommodation packages may vary by Event. Where tiered room or package options are available, Participants must actively select their preferred package to secure their spot (see Section 3).
2.3 Right to Modify Events
The Company reserves the right to modify any aspect of an Event, including but not limited to the schedule, activities, facilitators, accommodation, or location, where reasonably necessary. In the event of a material modification that substantially changes the nature of the Event, Participants will be notified as soon as practicable and offered the option to transfer to a future Event or receive a partial refund at the Company's discretion.
3. Registration, Payments, and Deposits
3.1 Spot Reservation and Room Selection
Registration for any Event is a two-stage process:
- Stage 1 — Deposit: A non-refundable deposit of $500 AUD is required to express interest and enter the registration queue. Payment of a deposit does not constitute a confirmed booking and does not reserve a specific room or package.
- Stage 2 — Room Selection and Full Booking: Following deposit payment, the Participant must actively select an available accommodation package within seven (7) calendar days. A Participant's spot is not confirmed or secured until a room package has been selected and the booking is completed in accordance with this Section.
3.2 Automatic Package Allocation
If the Participant fails to select an accommodation package within the seven (7) calendar day window stipulated in Section 3.1, the Company reserves the right to either:
- Automatically allocate the lowest-priced available package to the Participant and charge the payment method on file for the corresponding balance or initiate the applicable payment plan; or
- Cancel the Participant's registration and forfeit the deposit.
The Participant may upgrade to a higher-tier package at any time by paying the difference, subject to availability. By paying the initial deposit, the Participant expressly authorises the Company to act in accordance with this Section.
3.3 Final Payment Deadline
All remaining balances must be paid in full no later than sixty (60) days prior to the Event commencement date (the "Final Payment Deadline"). Where a payment plan is in place, all scheduled payments must be current and up to date by the Final Payment Deadline. Failure to meet this deadline may result in cancellation of the Participant's booking, forfeiture of all monies paid, and reallocation of the spot at the Company's sole discretion.
3.4 Pricing and Currency
All prices are quoted in Australian Dollars (AUD) unless otherwise stated. Prices are per person and are inclusive of the inclusions specified in the Event program. The Company accepts no responsibility for currency fluctuations or bank fees incurred by Participants making payment in foreign currencies.
4. Refund and Cancellation Policy
4.1 Non-Refundable Deposit
The initial $500 AUD deposit is non-refundable under all circumstances, including but not limited to illness, injury, personal circumstances, travel disruptions, visa refusals, or any other reason.
4.2 Seven-Day Refund Window
For Participants who proceed to complete a full booking by selecting an accommodation package, a full refund of all monies paid (excluding the non-refundable $500 AUD deposit) is available if the Participant cancels in writing within seven (7) calendar days of completing the full booking (the "Refund Window"). All refund requests must be submitted in writing to the Company within this timeframe. Refunds will be processed within fourteen (14) business days of the written request being received and approved.
4.3 Cancellations After the Refund Window
After the seven (7) day Refund Window has expired, all payments are strictly non-refundable under any circumstances. This applies regardless of the reason for cancellation, including but not limited to illness, injury, family emergencies, work commitments, visa refusals, travel disruptions, or any other personal circumstances. Comprehensive travel insurance is the Participant's primary protection against such events and is mandatory under Section 5.
4.4 Cancellation by the Company
In the unlikely event that the Company cancels an Event due to unforeseen circumstances (including but not limited to natural disasters, pandemics, acts of terrorism, political instability, government-imposed travel restrictions, or insufficient enrolment), all Participants will receive a full refund of all monies paid, including the initial $500 AUD deposit. The Company shall not be responsible for any travel expenses, visa fees, travel insurance premiums, or any other costs incurred by Participants in connection with the cancelled Event. This reinforces why comprehensive travel insurance is mandatory.
5. Travel Insurance
5.1 Mandatory Requirement
Comprehensive travel insurance is mandatory for all Participants attending any Event. Participants must obtain and maintain travel insurance from the time of completing their full booking through to the conclusion of the Event. At a minimum, this insurance must cover:
- Trip cancellation and curtailment;
- Medical emergencies and hospitalisation (including overseas medical expenses);
- Emergency evacuation and repatriation;
- Personal liability;
- Loss or damage to personal property; and
- Any activity-specific coverage required for activities included in the Event program.
5.2 Proof of Insurance
The Company reserves the right to request proof of valid travel insurance from any Participant prior to or at the commencement of an Event. A Participant who cannot demonstrate adequate insurance coverage may be denied entry to the Event without refund.
5.3 Company Documentation
The Company will provide reasonable documentation (including booking confirmations, receipts, and cancellation letters as applicable) to assist Participants in making insurance claims where necessary. The Company makes no representation as to whether any particular insurance policy will cover any particular circumstance and accepts no responsibility for insurance claim outcomes.
6. International Travel and Visa Responsibility
6.1 Participant Responsibility
For international Events, Participants are solely and entirely responsible for all matters relating to international travel, including but not limited to:
- Obtaining and holding a valid passport with sufficient validity for entry to the destination country (typically a minimum of six (6) months beyond the Event end date, though Participants must verify specific requirements);
- Researching, obtaining, and paying for any visas, entry permits, electronic travel authorities, or other documentation required to enter, transit through, or depart the destination country;
- Compliance with any health, vaccination, or testing requirements imposed by the destination country or any transit country;
- Monitoring and complying with any government travel advisories or warnings issued by the Australian Government (Smartraveller) or the relevant authority for the Participant's country of residence; and
- Arranging and covering all costs of international and domestic flights, ground transportation to and from the Event venue, airport transfers, and any other travel logistics not expressly included in the Event program.
6.2 No Liability for Travel Matters
The Company accepts no responsibility whatsoever for any consequences arising from a Participant's failure to obtain the correct travel documentation, comply with entry requirements, or adhere to travel advisories. This includes but is not limited to denied boarding, deportation, detention, fines, or any other consequences. No refund will be issued where a Participant is unable to attend an international Event due to visa refusal, documentation issues, or failure to comply with travel requirements.
6.3 Domestic Travel
For domestic Events, Participants are responsible for arranging and covering all costs of travel to and from the Event venue, including flights, ground transportation, and any accommodation required outside of the Event dates.
7. Plus Ones
7.1 Plus One Entitlement
Founders Pass members are entitled to bring one (1) Plus One to qualifying Founders Pass Events, subject to availability and the eligibility requirements set out in Section 1.2. Tickets for Plus Ones may be purchased under the member's booking. The presence of both tickets under a single booking name does not affect the individual obligations and responsibilities of the Plus One under these Terms and Conditions.
7.2 Plus One Obligations
Every Plus One attending an Event is individually bound by these Terms and Conditions in full, including but not limited to the Code of Conduct obligations under Section 8, the assumption of risk provisions under Section 9, and all travel and insurance requirements. The Founders Pass member who registers the Plus One accepts joint responsibility for ensuring the Plus One is aware of and complies with these Terms and Conditions prior to the Event.
7.3 Conduct of Plus Ones
Any breach of the Code of Conduct or these Terms and Conditions by a Plus One may result in removal of the Plus One from the Event and, at the Company's sole discretion, may also result in consequences for the Founders Pass member's membership, up to and including revocation of the Founders Pass membership. The member accepts this risk by registering a Plus One.
7.4 No Refunds for Plus One Removal
Where a Plus One is removed from an Event due to misconduct or breach of these Terms and Conditions, no refund will be issued for any monies paid in respect of the Plus One's attendance.
8. Spot Transfers
8.1 Transfer to Another Person
A Participant who is unable to attend an Event may request to transfer their spot to another eligible individual, subject to the following conditions:
- The transfer request must be submitted in writing to the Company at least sixty (60) days prior to the Event commencement date;
- The replacement Participant must satisfy all eligibility requirements under Section 1.2 and complete the Company's qualification process;
- The Company's written approval is required for all transfers; and
- The original Participant remains responsible for all outstanding payments regardless of the transfer.
8.2 Transfer to a Future Event
A Participant may request to transfer their spot (and all payments made) to a future Founders Pass Event, subject to the following conditions:
- The transfer request must be submitted in writing at least sixty (60) days prior to the original Event commencement date;
- Transfers are subject to availability and Company approval;
- All payments made will be credited toward the future Event. Where the future Event is priced higher, the Participant is responsible for paying the difference. Where the future Event is priced lower, no refund will be issued for the difference;
- Spots may only be transferred once and the credit must be used within twelve (12) months of the original booking date; and
- The initial $500 AUD deposit remains non-refundable and non-transferable in cash value, though it will be credited toward the future Event booking.
8.3 Transfers Within 60 Days
Transfer requests submitted fewer than sixty (60) days prior to the Event commencement date will not be accepted and no refund or transfer credit will be provided.
9. Participant Conduct and Code of Conduct
9.1 Code of Conduct
All Participants (including Plus Ones) are required to conduct themselves with respect, professionalism, and integrity at all times throughout any Event. By attending an Event, Participants agree to comply with the Driven Young Community Code of Conduct, which includes but is not limited to the following standards:
- Treating all fellow Participants, Company staff, facilitators, and third-party service providers with respect and dignity;
- Refraining from any form of discrimination, harassment, bullying, or intimidation based on race, gender, sexuality, age, religion, disability, or any other characteristic;
- Refraining from the use of illegal drugs or controlled substances;
- Complying with all applicable local, national, and international laws at all times;
- Not engaging in conduct that disrupts, endangers, or negatively impacts the safety, wellbeing, or enjoyment of other Participants or staff; and
- Refraining from behaviour that brings the Driven Young brand or community into disrepute.
9.2 Right of Removal
The Company reserves the right, at its sole and absolute discretion, to remove any Participant (including any Plus One) from an Event at any time where the Company reasonably believes that Participant has breached the Code of Conduct, violated these Terms and Conditions, or otherwise engaged in conduct incompatible with the values and standards of the Driven Young community. Where a Participant is removed from an Event:
- No refund of any monies paid will be provided;
- The Company may require the Participant to arrange their own travel and accommodation at their own cost with immediate effect; and
- The Company will review the circumstances individually and may, at its sole discretion, consider a partial or full refund depending on the specific facts, but is under no obligation to do so.
9.3 Membership Revocation
Where a Participant or their Plus One is removed from an Event due to a serious or repeated breach of the Code of Conduct or these Terms and Conditions, the Company reserves the right to revoke the Participant's Founders Pass membership entirely, effective immediately. In the event of membership revocation:
- No refund of the Founders Pass membership fee or any Event payments will be issued;
- The Participant forfeits all remaining benefits, credits, and entitlements associated with the Founders Pass membership; and
- The Company is not obligated to provide prior notice or a warning before exercising this right, though it may do so at its discretion.
9.4 Compliance with Local Laws
Participants must comply with all laws, regulations, and customs applicable in the jurisdiction in which the Event is held. The Company accepts no responsibility for any legal issues, fines, penalties, detention, or other consequences arising from a Participant's failure to comply with applicable laws.
10. Assumption of Risk and Liability Waiver
10.1 Assumption of Risk
Participants acknowledge and accept that participation in Events may involve inherent risks, including but not limited to physical injury, illness, accidents, loss or damage to personal property, and exposure to local environmental, health, and safety conditions. Participation in physical activities, excursions, and other programmed or optional experiences is entirely voluntary, and Participants assume all risks associated with their participation.
10.2 Health and Medical Needs
Participants are solely responsible for ensuring they are in good physical and mental health and are capable of participating in the activities offered during the Event. Any known medical conditions, allergies, dietary requirements, disabilities, or special needs must be disclosed to the Company in writing prior to the Event. The Company will use reasonable endeavours to accommodate disclosed needs but does not guarantee that all requirements can be met.
10.3 Liability Waiver
To the fullest extent permitted by applicable law, the Company, its directors, officers, employees, contractors, agents, and facilitators shall not be held liable for any injury, illness, death, loss, or damage to personal property occurring during or in connection with any Event, whether caused by negligence or otherwise. Participants agree to release, indemnify, and hold harmless the Company from any claims, demands, damages, costs, or expenses (including legal fees) arising from or related to their participation in any Event.
10.4 Staff Availability
Company staff will be present and available during scheduled Event activities and designated support hours, which will be communicated to Participants in the Event materials. Outside of designated staffed hours, Participants are responsible for their own wellbeing, safety, and conduct. An emergency contact number will be provided to Participants for urgent assistance outside staffed hours. The Company is not liable for any incidents, injuries, or issues arising outside of staffed hours.
11. Force Majeure
The Company shall not be liable for any failure, delay, or inability to perform its obligations under these Terms and Conditions arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics or public health emergencies, war, terrorism, civil unrest, government-imposed travel restrictions or border closures, strikes or industrial action, or any other event that could not have been reasonably anticipated or prevented. In such circumstances, the Company will use reasonable endeavours to reschedule or restructure affected Events and will communicate with Participants as soon as practicable.
12. Indemnification
Each Participant agrees to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, agents, contractors, and facilitators from and against any and all claims, liabilities, damages, losses, fines, penalties, or costs (including reasonable legal fees) arising out of or in connection with:
- The Participant's participation in any Event;
- Any breach by the Participant (or their Plus One) of these Terms and Conditions;
- Any breach by the Participant (or their Plus One) of any applicable law or regulation; or
- Any act or omission of the Participant (or their Plus One) that causes loss or damage to the Company, other Participants, or any third party.
13. Dispute Resolution
Any dispute arising out of or in connection with these Terms and Conditions shall be addressed through the following process:
- Good Faith Negotiation: The parties agree to first attempt to resolve the dispute through good faith negotiation within twenty-one (21) days of the dispute arising.
- Mediation: If the dispute is not resolved through negotiation, it shall be referred to mediation in Sydney, New South Wales, Australia, conducted by a mutually agreed mediator.
- Binding Arbitration: If mediation fails to resolve the dispute, it shall be submitted to binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA). The arbitration shall be conducted in Sydney, New South Wales, Australia. Each party shall bear its own legal costs and fees regardless of the outcome.
14. General Provisions
14.1 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Participants irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia for the resolution of any disputes not resolved through the process in Section 13.
14.2 Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall not be affected or impaired.
14.3 Amendments
The Company reserves the right to amend these Terms and Conditions at any time. Participants will be notified of material changes via email to their registered address. Continued participation in Events following notification of changes constitutes acceptance of the amended Terms and Conditions.
14.4 Entire Agreement
These Terms and Conditions, together with any Event-specific terms communicated at the time of registration, constitute the entire agreement between the Participant and the Company in relation to the relevant Event and supersede all prior or contemporaneous communications, whether written or oral.
14.5 Waiver
A failure or delay by the Company to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy, nor does it prevent or restrict any further exercise of that or any other right or remedy.
Acknowledgement
By registering for or attending any Driven Young Founders Pass Event, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety, including the non-refundable deposit, cancellation policy, assumption of risk, Code of Conduct obligations, and international travel responsibilities.
